MEMBERSHIP IN INTERNATIONAL CONVENTIONS

  • Paris Convention, since December 25, 1995.
  • Patent Cooperation Treaty, since December 25, 1995.
  • Eurasian Patent Convention, since December 25, 1995.

FILING REQUIREMENTS

  • Power of Attorney (no legalization; notarization required in absence of the applicant’s company seal);
  • Specification, claims and abstract (to be translated into Azeri);
  • Drawings;
  • Priority document, if priority is claimed, to be filed within three months from the filing date.

REMARKS

National Phase of PCT: under Chapter I: 30 months; under Chapter II: 31 months.
Validity: twenty years from the filing date.
Annuities: the accumulated annuities are payable after receipt of the allowance decision; subsequent annuities are due on the anniversary of the filing date.
Opposition: is possible within six months from the publication of a patent application, and within six months following the publication of a granted patent.

FILING REQUIREMENTS

  • Power of Attorney (no legalization; notarization required in absence of the applicant’s company seal);
  • Prints of the sign to be protected (15);
  • List of goods and/or services, according to the International Classification; one application may include goods belonging to more than one International Class (to be translated into Azeri);
  • Priority document, if any (to be filed within three months from the filing date).

REMARKS

Kinds of protection: trademarks and service marks (word marks, device marks and combinations thereof). Besides the original version, filing of word mark applications in the Azeri language, as well as in the Cyrillic alphabet is highly recommended, as the Russian language is still being a parallel language in the country.
Classification: International.
Obligation to use the registered mark: must be used; if not used within any five-year period after the registration (or last use) date, the mark can be cancelled upon request of an interested party; nominal use (advertising, publications) is accepted in absence of actual use.
Duration – renewals: 10-year period after the filing date or last renewal date (note: marks re-registered on the basis of the former Soviet Union registrations are due for renewal 10 years after the Azeri filing date, or the last renewal date in the former Soviet Union).
Opposition: possible, within a five-year term after publication of the registered trademark.

Opposition: is possible within six months from the publication of an industrial design application, and within six months following the publication of a granted industrial design.

  • There are no specific laws nor published regulations on domain name registration under the .az country code top-level domain name for Azerbaijan.

General Remarks

Azerbaijan used to be part of the former Soviet Union. The republic declared its independence on August 30, 1991. The Patent and License Department of the State Committee of Science and Technology was established in June 1993. The Office was re-organized, and the Patent Department of the State Committee for Standardization, Metrology and Patents established in August 2002.
