GENERAL REMARKS

New Patent and Trademark Laws were approved by the Georgian Parliament on February 4, 1999, and came into force on May 24, 1999. The Patent Law was last amended on May 15, 2024 (in force since January 1, 2025). The Trademark Law amendments are in force since January 1, 2025. The Law of Designs amendments are in force since November 11, 2025. A new law regarding Patent Attorneys came into force on January 1, 2025.

 

 

PATENTS OF INVENTION

LEGAL BASIS

  • Patent Law of February 4, 1999, in force since May 24, 1999, last amendments in force since January 1, 2025.

 

MEMBERSHIP IN INTERNATIONAL CONVENTIONS

  • Paris Convention, since January 18, 1994.
  • Patent Cooperation Treaty, since March 18, 1994.

 

FILING REQUIREMENTS

  • Power of Attorney, simply signed;
  • Assignment of rights to patent, if the inventor is not the applicant;
  • Specification and abstract (may be filed in Georgian or any other language whereby the certified Georgian translation should be filed within a two-month term);
  • Drawings, 1 set;
  • Georgia joined the WIPO Digital Access Service (DAS), therefore a copy of the priority document(s) is available for Examiners by the DAS.

 

REMARKS

National Phase of PCT: under Chapter I: 31 months; under Chapter II: 31 months.

Validity: 20 years from the filing date.

Annuities: as of June 2, 2023, annuities must be paid beginning from the third year from the date of filing the application.

Opposition: third parties may request secondary examination (re-examination) of a patent at any time after registration.

 

 

TRADE AND SERVICE MARKS

LEGAL BASIS

MEMBERSHIP IN INTERNATIONAL CONVENTIONS

  • Paris Convention, since January 18, 1994.
  • Madrid Protocol, since May 20, 1998.

 

FILING REQUIREMENTS

  • Power of Attorney, simply signed;
  • The representation of the trademark;
  • List of goods and services according to the 13th Edition of the Nice Classification;
  • Priority document, if any (to be filed within three months from the filing date). Georgia joined the WIPO Digital Access Service (DAS), therefore a copy of the priority document(s) is available for Examiners by the DAS.

 

REMARKS

Kinds of protection: word marks, device marks or combinations of both, two and three-dimensional designations. Collective and service marks are registrable. Besides the original version, filing of word mark applications in the Georgian Script is highly recommended. It is also recommended to file the Cyrillic version, especially if the mark is protected in the entire territory of the former Soviet Union.

Classification: International.

Obligation to use the registered mark: compulsory. A trademark, which is not used during any five-year period after the registration date (or the last date of use), may be cancelled upon request filed by an interested party.

Duration – renewals: 10 years from the registration date, renewable for further periods of 10 years.

Opposition: possible within three months from publication of the decision to grant the trademark.

INDUSTRIAL DESIGNS

LEGAL BASIS

  • Law on Designs of May 2010, in force since June 24, 2010, last amendments in force since November 11, 2025.

 

MEMBERSHIP IN INTERNATIONAL CONVENTIONS

  • Paris Convention, since January 18, 1994.
  • Hague Agreement, since August 1, 2003, Geneva Act, since December 23, 2003.

 

FILING REQUIREMENTS

  • Power of attorney, simply signed;
  • The design itself or, when not appropriate, photographs or drawings thereof (3 main view);
  • Specification of the model, if necessary;
  • Priority document, if any. Georgia joined the WIPO Digital Access Service (DAS), therefore a copy of the priority document(s) is available for Examiners by the DAS.

 

REMARKS

Duration – renewals: 5 years from the filing date, renewable for four further 5-year terms. Maximum validity: 25 years.

Opposition: within three months from the publication date.

  • There is no specific legislation on country code top-level domain names.
